On 1 October 2024, the National Telecommunications Agency of Brazil (ANATEL) published Public Consultation No. 48 on the technical requirements for 5G NR-NTN, RedCap (FR1) and LTE Cat 1bis. Act No. 3151 and Act No. 3152 will be amended to refer to 3GPP TS 38.521-1 V17.7.0 (2023-02) for 5G and 3GPP TS 36.521-1 V16.8.1 (2021-05) for 4G.

On July 12, 2024, the National Telecommunications Agency of Brazil (ANATEL) launched a public consultation on restricting the certification of devices that only support 3G or lower, with the following main contents:

• In the annex to the Ato Decree of June 12, 2020, new requirements numbered 4.4 and 4.5 were added to the annex, with clause 4.4 prohibiting the authentication of modules or terminal devices up to 3G, and clause 4.5 requiring that voice-enabled modules or terminal devices must support VoLTE technology
• In the annex to the Ato 3152 Decree of June 13, 2020, new requirements numbered 4.5 and 4.6 were added, with Article 4.5 prohibiting the certification of mobile phones up to 3G and Article 4.6 requiring that mobile phones must support VoLTE technology
• For automotive components, modules or end devices that support up to 3G can still be certified;
• The original certified devices that support up to 3G will continue to be valid.

On May 29, 2024, Brazil's telecommunications regulator, ANATEL, announced a public consultation on the proposed update to the technical standard for radiocommunication equipment, under public consultation number No. 29. The purpose of this public consultation is to gather feedback on the revision of equipment requirements for the 5925 MHz - 7125 MHz band.

The proposed changes include limiting the operating frequency from 5925MHz - 7125MHz to 5925 MHz - 6425 MHz and requiring remote firmware updates to comply with ANATEL regulations. Since there are already products on the market that use this technology, adjustments will need to be made to meet new regulatory standards, which can create challenges for manufacturers and businesses operating in Brazil.

On March 20, 2024, the Brazilian National Telecommunications Agency (ANATEL) issued a letter numbered 100/2024/ORCN/SOR-ANATEL clarifying the requirements of Ato 2436 "Minimum Cybersecurity Requirements for Assessing the Conformity of CPE (Customer Premises Equipment) Devices". The letter states that this cybersecurity test is only applicable for end-user CPE devices, with the exception of CPE devices used by enterprises.

Following a public consultation on the new mobile phone charger by the Brazilian Telecommunications Agency (ANATEL) on September 6, 2023, ANATEL published a new regulation, Ato 5155, on April 17, 2024, containing guidelines and test scopes for this product type, which will enter into force on October 14, 2024. The ATO 5155 Act defines safety and EMC testing requirements for DC/DC, AC/DC, and inductive mobile phone chargers. The new Act replaces Act No. 5159 issued in 2022 and Act No. 3481 issued in 2019.

On December 14, 2023, the Brazilian National Telecommunications Agency (ANATEL) issued announcements numbered No.463/2023/ORCN/SOR-ANATEL and No.464/2023/ORCN/SOR-ANATEL, postponing the timing of the laboratory's accreditation to December 14, 2024:

• Ato 7971 "Technical Requirements for Approval and Assessment of IPv6 Protocol Compliance in Telecommunications Products" published on June 22, 2023. As the requirements of Ato 7971 are consistent with the IPv6 evaluation requirements of existing telecommunications products, ORCN, the certification and number management agency responsible for ANATEL, has recognized ipv6 test qualified laboratories which support Technical Requirements List - Class I to implement ato 7971 testing for a period of 1 year until the laboratory is accredited per Ato 7971;
• Ato 17087 "Technical Requirements for Approval of Electrical Safety in Conformity Assessment of Telecommunications Products" issued on December 19, 2022 Since the requirements of Ato 17087 are consistent with the requirements of the existing Ato 950, ANATEL allows laboratories with the original Ato 950 qualification to test according to Ato 17087 for a period of 1 year until the laboratory obtains the qualification of Ato 17087. ANATEL also subsequently released No.466/ 2023/ORCN/SOR-ANATEL announcement is only an errata to Announcement No. 463. In addition, ANATEL has announced that it will waive the obligation of visual inspection of product labelling by laboratories until March 27, 2024.

Following the approval of Resolution 715 of October 23, 2019, on February 29, 2024, the Brazilian National Telecommunications Agency (ANATEL) issued Public Consultation No. 13 on the reassessment of the Regulations on Conformity Assessment and Approval of Telecommunication Products. This public consultation concerns the proposed amendments to the Brazilian Regulation on Conformity Assessment and Approval of Telecommunications Products. The current regulations are designed to speed up the approval process and improve the flexibility of approval, but there are also some problems that need to be improved in light of the actual situation. The proposed amendments aim to adapt the regulation to technological advances, address piracy and e-commerce, expand eligibility for approval, and reduce barriers for importers. Previously, the certification of refurbished products was exempt, but this draft mentions that refurbished products are allowed to be certified, but must include a logo to distinguish them from products manufactured in ordinary processes.

On November 21, 2023, the Brazilian National Telecommunications Agency (ANATEL)  published the official letter 429/2023/ORCN/ SOR-ANATEL. The letter formalizes ANATEL's requirement that all test reports, whether done in Brazil or abroad, must follow and meet the requirements of Act 4083, including traceability information.

Under Act No. 7280, ANATEL accepts reports from foreign laboratories for certain products, such as non-RF network switches, optical line terminals (OLTs), digital multiplexers, coaxial cables, certain types of fiber optic cables, satellite transceivers, etc., for business/industrial use. Section 6.3.1.5 of Act 4083 stipulates that before starting testing, the manufacturer or applicant must formally communicate the following information to the Designated Certification Body (OCD):

• the manufacturing unit that produced the sample, and
• the traceability of the sample submitted for testing.

According to the requirements of the letter, from now on foreign laboratories must be approved by the OCD before they can begin testing.

On March 7, 2023, the Brazilian National Telecommunications Agency (ANATEL) published Bill No. 2436 on its website. The purpose of the Act is to establish a mandatory set of enforceable minimum cybersecurity requirements (password strength, data sharing, vulnerability updates, etc.) to assess the compliance of the following user-end devices for general public use that connect users to Internet services. Typical equipment includes modems, routers, and wireless access points.

The Brazilian National Telecommunications Agency (ANATEL) issued Ato 13011/2023 on September 1, 2023, again postponing the execution of Ato 5159/2022. According to Act 13423/2022, the mandatory date for Ato 5159 is 21 October 2023, while according to the newly published Ato 13011/2023, power adapters used by mobile phones can still be tested and evaluated with Ato 3481/2019 until 18 April 2024. ATO 13011/2023 has come into effect on September 4, 2023.
