Brazil: ANATEL terminates FDD device certification for the 1880-1920 MHz band

On August 20, 2025, Brazil's National Telecommunications Authority (ANATEL) issued a circular numbered 246/2025/ORCN/SOR-ANATEL, confirming that all new and existing cellular equipment (approved or about to be approved) will not be able to use FDD Band 2 (1880-1920 MHz). Even during the renewal process, ANATEL confirmed that this FDD band was not considered.

Brazil: CONAMA launches public consultation on Brazil's new RoHS regulation

On August 8, 2025, Brazil's National Environment Commission (CONAMA) conducted a public consultation on the proposed RoHS (Restriction of Hazardous Substances) regulations for electrical and electronic equipment. Inspired by the EU RoHS Directive, the regulation aims to restrict the use of certain hazardous substances in various electronic products, and the main hazardous substance restriction requirements are consistent with the current EU RoHS Directive. The draft provides a two-year transition period for the hazardous substance disposal label (trash can icon with an X) that needs to be reflected on the product.

Brazil: ANATEL issues Resolution 780

On August 1, 2025, Brazil's National Telecommunications Authority (ANATEL) issued Resolution 780, providing important clarifications on the Brazilian telecommunications product certification process. This resolution is in addition to Resolution 715 of ANATEL's primary certification regulations. The resolution clarifies topics such as market obligations and responsibilities, general rules for the use of ANATEL labels, and the use of the Consumer Protection Act. The resolution also affirms that data centers that are part of the telecommunications network must be approved by ANATEL.

Brazil: ANATEL approves regulatory simplification project

On April 3, 2025, Brazil's National Telecommunications Regulatory Agency (ANATEL) approved the "Regulatory Simplification Project", which will carry out major reforms in the telecommunications sector. The main changes are as follows:

  • Consolidation of regulatory acts into a single framework, such as the approval of the General Telecommunication Services Regulation (RGST) and the Regulatory Experimental Environment Regulation;
  • updating the Temporary Regulations on the Use of Radio Frequencies and adjusting internal regulations;
  • repeal outdated regulations, update definitions, and improve rules for public interest services and restrictive services;
  • Introduce a unified glossary to improve the comprehensibility and clarity of regulations.

Brazil: ANATEL publishes Act No. 2105

On February 14, 2025, Brazil's National Telecommunications Agency (ANATEL) published Act No. 2105 updating the technical requirements for the certification of cellular devices (Access Terminal Stations (ETAs) and mobile phones). This new bill sets out testing requirements for devices using technologies such as 5G NB-NTN (Narrowband Non-Terrestrial Network), 5G RedCap, and 4G LTE Cat 1bis. The bill will take effect from the date of publication and will be enforced on August 13, 2025.

Brazil : ANATEL issues Resolution No. 772 of 2025

On January 16, 2025, the Brazilian National Telecommunications Agency (ANATEL) issued Resolution No. 772 of 2025 approving a new plan for the allocation and allocation of frequency bands in Brazil. The effective date of the resolution is February 3, 2025.

This new resolution changes Annex I of Resolution 680, which is Brazil's main standard for restricting radiated emissions from wireless devices in certain frequency bands. Other parts of resolution 680 remain in force. The resolution also replaces a number of previous regulations, such as Resolution 759 of 2023 and Resolution 766 of 2023.

Brazil: ANATEL publishes guidelines for cybersecurity audits for telecom equipment suppliers

On November 26, 2024, Brazil's National Telecommunications Agency (ANATEL) issued Decree No. 16417, which contains operational procedures and guidelines for auditing cybersecurity policies for suppliers of telecommunications products and equipment of telecommunications service providers. The decree is now in force and will be enforced from 26 November 2025.

Brazil: ANATEL issued Act No. 14430, which requires terminals and modules to support 4G or higher

On October 7, 2024, the National Telecommunications Agency of Brazil (ANATEL) published Act No.14430, updating the certification requirements of Act No.3151/2020 for access terminal stations and mobile cellular phones.

The act stipulates that from April 6, 2025, only mobile phones and access terminals equipped with at least 4G or higher technology will be certified. The new standard allows for the certification of devices with 2G and 3G technologies, provided they also include 4G or higher capabilities. The main objective of these new requirements is to ensure that ANATEL-approved devices remain compatible with the latest networks (4G and 5G). The measure is designed to protect users of telecommunications services and products from potential losses by preventing disruptions when operators phase out 2G and 3G networks.

Brazil: ANATEL published public consultation regarding the standards of 5G NTN, RedCap and LTE Cat 1bis

On 1 October 2024, the National Telecommunications Agency of Brazil (ANATEL) published Public Consultation No. 48 on the technical requirements for 5G NR-NTN, RedCap (FR1) and LTE Cat 1bis. Act No. 3151 and Act No. 3152 will be amended to refer to 3GPP TS 38.521-1 V17.7.0 (2023-02) for 5G and 3GPP TS 36.521-1 V16.8.1 (2021-05) for 4G.
